A supplement label says "supports immune function". Four words, and behind them sit a permitted claim, a nutrient present at a specified level, and a body of evidence somebody once assessed. Change one word to "boosts", or apply the claim to a product that does not contain enough of the nutrient, and the same four words become an unlicensed medicinal claim. The chemistry is unchanged. The regulatory position is entirely different.

Claim wording and its substantiation is where this industry gets into difficulty, and the failure is treating a permitted claim as a phrase rather than as a package. A permitted claim comes with conditions — a minimum amount of the nutrient, a defined portion, a specified population, and often required accompanying wording — and using the phrase without meeting the conditions is using it unlawfully. We work through these so each claim on the pack is mapped to its authorised wording, its conditions of use and where the product meets them, since the mapping is what an enforcement officer will ask for and most companies assemble it after the letter arrives; so any adaptation of authorised wording is checked to have the same meaning for a consumer rather than merely a similar one, given that "helps maintain" and "improves" are different claims; so implied claims made by imagery, product names, testimonials and adjacent text are assessed as claims, because the whole presentation carries the message and a compliant sentence beside a picture of an athlete is not a compliant page; so anything referring to a disease is identified as a medicinal claim, however phrased; so marketing copy, influencer briefs and affiliate material are held to the same standard as the label, as this is where most enforcement now originates; and so the substantiation file is written so somebody who was not there can follow it. Companies that document this way are asked fewer questions and answer them faster.
